Play Hockey Canada Inc. (“PHCI”), Play Hockey USA Inc. (“PHUS”) and their respective directors, officers, owners, agents, representatives, employees, affiliates, partners and subsidiaries (collectively, "Play Hockey Group", "we", "us" or "our") is committed to protecting and respecting your privacy and the privacy of all Players, Registrants and Users (each as defined below).

This Privacy Policy describes how and why we might collect, store, use, share, disclose or otherwise process Personal Information we collect about you and others when you: (i) visit our website, www.playhockey.com, (our “Website”) the Play Hockey Group mobile application (our "App", and together with our Website and all other websites or applications offered by Play Hockey Group from time to time, collectively referred to as our “Platforms”); (ii) use any of the products, services, features, technologies and software offered through or in connection with our Platforms; (iii) participate in, attend, or register a Player for any events, programs or other activities provided or hosted by Play Hockey Group (collectively, the “Events”); (iv) purchase our products; or (v) engage with Play Hockey Group in any other way (collectively, our "Services").

For the purpose of this Privacy Policy: (i) “Registrant” refers to any individual who lawfully registers or enrolls a Player in an Event; (ii) "Player" refers to any Minor registered for or enrolled in an Event; (iii) "Minor" refers to an individual who is under the age of majority in their jurisdiction of residence; (iv) “User” refers to an individual has access and uses any of our Platforms or related Services; and (v) “Personal Information” refers to information about an identifiable individual, but does not include anonymous, de-identified or aggregated information that does not include an individual’s name, contact information or any other information that could reasonably be expected to identify or be linked to an individual.

References to “you” and “your” in this Privacy Policy are references to any and all individuals who: (i) disclose Personal Information to us; (ii) are of the age of majority in their jurisdiction of residence and have authorized a Minor’s disclosure of Personal Information to us; (iii) participate in or register Players for Events; or (iv) has access and uses any of our Platforms or Services.

Acceptance of this Privacy Policy

This Privacy Policy applies to your use of our Services and to all Personal Information collected by or disclosed to us, whether online or offline, and is in addition to any other contractual terms that you may enter into with Play Hockey Group. By accessing/using our Services and/or disclosing Personal Information to us (whether directly or indirectly), you are confirming that you have read and understand the terms of this Privacy Policy and of our Terms and Conditions of Use (our “Terms of Use”) and that you agree to each of such terms. Use of the Services is strictly voluntary. IF YOU DO NOT AGREE WITH OUR POLICIES AND PRACTICES, YOU ARE PROHIBITED FROM ACCESSING OR USING OUR SERVICES, DOWNLOADING OR INSTALLING ANY OF OUR PLATFORMS, OR AUTHORIZING A MINOR TO DO ANY OF THE FOREGOING. Additionally, we may not be able to assist you in connection with matters related to the Platforms, our products or Services.

Multi-Jurisdictional Use, Collection and Disclosure

PHUS is based in Minnesota, U.S.A, and PHCI is based in Manitoba, Canada., and Personal Information may be stored in both and/or transmitted between Canada and the United States, and such other countries where relevant third party service providers are located. Personal information collected by us may be shared, transmitted and stored outside of your country of residence (or where our services were provided) and may not be protected to the same degree as under the data protection laws of your country of residence. YOUR USE OF THE SERVICES OR PROVISION OF ANY INFORMATION THEREFORE (EITHER DIRECTLY TO US OR INDIRECTLY THROUGH ONE OF OUR SERVICE PROVIDERS) CONSTITUTES YOUR CONSENT TO THE (i) COLLECTION, (ii) USE, (iii) STORING, (iv) SHARING, (v) DISCLOSING, (vi) ADMINISTRATION, (vii) TRANSFERRING (TO AND FROM PLAY HOCKEY GROUP), AND (viii) PROCESSING, OF YOUR PERSONAL INFORMATION AND ANY RELATED INFORMATION IN/ACROSS ANY OF THOSE JURISDICTIONS AND AS SET FORTH IN THIS PRIVACY POLICY.

IF YOU ARE SUBMITTING PERSONAL INFORMATION OF THIRD PARTIES TO US, YOU WARRANT AND REPRESENT YOU HAVE THEIR CONSENT TO PROVIDE THEIR PERSONAL INFORMATION TO US AND YOU WILL INDEMNIFY US AND HOLD US HARMLESS FROM AND AGAINST CLAIMS BY SUCH INDIVIDUALS RELATING TO OUR PROCESSING AND USE OF SUCH PERSONAL INFORMATION WITHIN THE TERMS OF THIS PRIVACY POLICY.

QUEBEC RESIDENT NOTICE: Play Hockey Group regrets that its services are presently not open to residents of Quebec. If you are a resident of Quebec, do not send or permit your Personal Information to be sent to Play Hockey Group at the present time.

ALBERTA RESIDENT NOTICE: pursuant to The Personal Information Protection Act (Alberta), Play Hockey Group advises that it uses service providers located outside of Canada to collect Personal Information. We may also use such service providers to manage our data outside of Canada and may transmit Personal Information outside of Canada accordingly. Please contact Play Hockey Group's privacy officer if you have questions or require further information concerning our practices and with respect to service providers located outside of Canada (see contact us section at the end of this privacy policy.)

NOTICE TO USERS/REGISTRANTS/PLAYERS FROM OUTSIDE OF NORTH AMERICA: Play Hockey Group regrets that its services are presently not open to residents outside of Canada and the United States. If you are a resident from outside of Canada or the United States, do not send or permit your Personal Information to be sent to Play Hockey Group at the present time.

Collection

We collect Personal Information as necessary to provide our Services. Our collection practices are designed to comply with the consents you provide to the collection, use and disclosure of your Personal Information. You may, from time to time, choose to provide Play Hockey Group with Personal Information in addition to that which is required for the provision of our Services for specific purposes as outlined at the time of collection (i.e., to participate in surveys, promotional contests, etc.).

We collect your Personal Information through various means, including when you provide it to us by contacting Play Hockey Group directly or by access and/or using our Services, from our third party registration/data processing service providers when you access and/or use our Services, when you authorize a third party to provide your Personal Information to us (for example when an Registrant registers a team for a Play Hockey Group event), as well as automatically through your use of our Platforms, or when you connect with Play Hockey Group through our various social media platforms. We have set out our collection practices in more detail below.

We may also collect and assemble certain Personal Information over the course of the delivery of our Services, such as event schedules, roster information, Player statistics, play level and age groups, and other game play information (goals, penalty minutes etc.), Player positions and otherwise. Personal Information that we collect and assemble over the course of the delivery of our event or activity services may be made publicly available on our Platforms, any other applications we offer or on our social media platforms in connection with our event and activity administration and operations. Play Hockey Group also reserves the right to photograph and record Events and Play Hockey Group may publicly display, distribute or broadcast those photographs/recordings, now or at any point in the future pursuant to provided consents.

Play Hockey Group may also acquire Personal Information in connection with businesses or business assets that we acquire, which we will administer in accordance with applicable laws.

We have set out specific details below concerning the general categories of Personal Information that Play Hockey Group collects and specific requirements regarding our privacy practices:

  1. Play Hockey Group Event and Activities Registration Information

(i) Registration/Data Processing Service Providers

In order to provide our Services and to collect Personal Information to facilitate registrations for Events and other Services, Play Hockey Group may use the services of third party registration/data processing service contractors to facilitate your registration and/or the registration of a Player and to collect Personal Information for Play Hockey Group. When you select to register for Events through our Website (whether in connection with the registration of a Player or a team), you may be automatically redirected to the applicable Play Hockey Group designated registration/data processing service contractor. In the event a third party service is used to complete your registration/the registration of a Player and/or team please note that you will also be subject to third party terms and conditions in addition to those of Play Hockey Group. Your Personal Information otherwise remains under the control of Play Hockey Group.

(ii) Parent/Legal Guardian Registrant Requirement

Players may be registered for Events through either (i) individual registrations by parent/legal guardian Registrants, or (ii) team registrations made by an organizational head, team coach or team manager Registrants where Player information is provided to Play Hockey Group as part of a roster, following which parent/legal guardian Registrants are contacted to complete the Player registration process.

Individuals who are submitting team registrations to Play Hockey Group for team Events will register with Play Hockey Group and, in connection with such registration, provide Play Hockey Group with a roster containing Player names, birth dates and parent/legal guardian email addresses. Play Hockey Group will use the Personal Information provided in connection with the team registration to contact the Player’s parent(s)/legal guardian(s) concerning the Events and to finalize the Player’s registration.

Parent/legal guardian consent and registration is mandatory for all Players to be registered as participants in all Events. By completing the registration of a Player, you as the parent/legal guardian of such Player are acknowledging and agreeing that the organizational head, team coach or team manager Registrant shall have access to all communications relevant to the Player as a team member for the duration of the team Events and related activities.

Players are NOT permitted to register directly for Events and must be registered by a parent/legal guardian as part of the registration process.

Play Hockey Group does not knowingly collect Personal Information directly from Players during the registration process, and intends that all communications are with their parent(s)/legal guardian(s).

  1. Play Hockey Group App/Website User Information

When you engage in certain activities on the Website, utilize certain features of the Website, or otherwise interact with us, we may ask you to provide personal and other information. Whether or not you provide this information is your choice; however, if you do not provide the required information for a particular activity, you will not be able to engage in that activity. You may also limit your ability to use all or a portion of the Website. In order to access and/or use our Platforms and related Services, you must first create a user account (an “Account”). Accordingly, Play Hockey Group requires that you provide certain Personal Information in order to establish your account, including without limitation, your legal name, country of residence and date of birth. Play Hockey Group may ask you to provide your personal email address (or your parent(s)/legal guardian(s) email address if you are a Minor), to create a unique password and/or to use your sign-in credentials if provided from a third-party social media or other platform (e.g., Google, Apple, etc.) ("third-party credentials"). If you use third-party credentials to sign-in to your Account, please note that you will also be subject to such third party’s terms and conditions in addition to those of Play Hockey Group. Your Personal Information otherwise remains under the control of Play Hockey Group.

  1. Third Party Information

Given the nature of our business and our Services, it may be necessary for us to collect Personal Information concerning users of our Services generally, as well as other Players, teams, Registrants, Users, spectators or other participants depending on the nature of the Events or other requested Service.

If you are submitting third party Personal Information to Play Hockey Group in connection with the registration of a Player, whether as an organizational head, team coach, team manager, parent/legal guardian or otherwise, or in connection with the creation of an Account or use of our Services or otherwise, you are confirming to Play Hockey Group that: (i) you have advised all such third parties or, in the case of third parties who are Minors, all such Minors’ parent(s)/legal guardian(s), that you will be providing their Personal Information to Play Hockey Group in connection with our Services, (ii) you have obtained all necessary approvals, consents, permissions and authorizations from all such third parties or, in the case of third parties who are Minors, you have obtained all necessary approvals, consents, permissions and authorizations from all such Minors’ parent(s)/legal guardian(s), to disclose and submit their Personal Information, in any form whatsoever, to Play Hockey Group and for Play Hockey Group to collect, use, disclose, store, duplicate, delete or modify such Personal Information, and (iii) you have the legal authority to submit such Personal Information to Play Hockey Group.

  1. Information We Collect or Receive When You Attend Our Events or Activities and/or Use our Services

Play Hockey Group also collects or receives Personal Information about you when you attend our Events and when you use our Services.

(i) User Generated Content

When you use our Platforms or any of our social or content features, any information, text, links, graphics, photos, audio, visuals or other materials or arrangements of materials (collectively referred to as “Content”) that you share, upload or disclose may be read, copied, collected, or used by other users and/or Play Hockey Group, and may become publicly available and/or may be processed by Play Hockey Group for the purposes described in this Privacy Policy and our Terms of Use, which forms part of this Privacy Policy.

(ii) Subscriptions for Play Hockey News

Subject to the communication options that you have selected, Play Hockey Group provides a subscription e-newsletter sent via email concerning notable happenings in terms of hockey and our Events and other Services.

(iii) Photographs, Recordings and Broadcasting Rights

As a condition of attendance and participation in Events, Play Hockey Group reserves the sole and exclusive right to take photographs and/or audio/video recordings of all such Events, and to broadcast same. Accordingly, other information (such as your likeness) that you may provide as part of your participation in or attendance at Events may be collected automatically by Play Hockey Group. All persons who attend or participate in Events, or, in the case of a Minor, all parent(s)/legal guardian(s) who authorize a Minor’s attendance or participation in Events: (i) authorizes Play Hockey Group to collect and use such Personal Information; (ii) consents to photographs and audio/video recordings of themselves and/or such Minor, in any format and any medium now known or hereafter developed, (iii) irrevocably grants Play Hockey Group the perpetual and irrevocable right and license to take, edit, use, display, publish, distribute, reproduce, broadcast, or to make compilations of the photographs and/or audio/video recordings taken of them and/or such Minor or which captures their and/or such Minor’s recognizable image, likeness and/or voice for both non-commercial and commercial purposes, including for publication, promotion, advertising, trade and/or instructional purposes concerning Play Hockey Group or any of its related or affiliated companies and their undertakings; (iv) acknowledges, on their own behalf and/or on behalf of such Minor that Play Hockey Group owns all rights in and to all such photographs and/or audio/video recordings, that these rights are granted without cost or charge to Play Hockey Group, and that no consideration or payment will be paid or payable by Play Hockey Group to them or their Minor on account of the use of those photographs and/or audio/video recordings; (v) to the fullest extent permitted by law, waives and releases any rights, claims or demands that they and/or such Minor may have against Play Hockey Group with respect to such photographs and/or audio/video recordings taken of them and/or such Minor at the Events, including, without limitation, any right to inspect or approve photographs and/or audio/video recordings capturing their and/or such Minor’s image, likeness and/or voice, any claims for invasion of privacy, violation of the right of publicity, defamation and copyright infringement or for any fees for use of such recorded media; and (vi) waives any and all moral rights that they and/or such Minor may have in any of the photographs, audio/video records and any other materials that incorporate their and/or such Minor’s image or likeness.

(iv) Team and Player Information

In connection with event administration, and as part of its business and promotional undertakings, Play Hockey Group may assemble, distribute and publish on our Platforms or any other applications or Services we offer or otherwise event schedules, roster information, Player game information and statistics, play level and age groups, and other game play information (goals, penalty minutes etc.), Player positions and other pertinent information.

(v) Website, App and Technology

In general, you can browse the Website without telling us who you are or revealing any personal information about yourself. However, Play Hockey Group may collect information from you automatically when you access any of our Platforms or use our Services ("Usage Information"). Usage Information may include your IP address, device identifier information (which may include without limitation the type/brand of device you are using, device identifiers unique to your device, your internet service provider, and Content that you have stored on your phone), browser type, operating system, information about your use of our Platforms and our Services, and data regarding network connected hardware and the length of time spent on our Services and your App and/or Website use and activity.

We collect some of this information using cookies, log files and other tracking technologies such as web beacons to collect and store information about your interactions with our Platforms including without limitation information about your browsing behavior. We use these technologies generally to offer you a more personalized and relevant experience based on your interests and to improve our Services and our Platforms.

The methods we use to collect Usage Information include:

Log Files. Log files contain information about your use of our Services, such as IP address, browser type, internet service provider, referring/exit pages, operating system, date/time stamps, and related data.

Cookies. We use cookies and other tracking technologies (such as web beacons) to collect and store information about your interactions with our Platforms. Cookies are small files that an application transfers to your device that enable the application’s or a third party’s systems to recognize your device and to capture and remember certain information. Web beacons (also known as tracking pixels) are tiny graphics embedded invisibly on an application or in an email that may be used to deliver or communicate with cookies, to count users who have visited certain pages, and to understand usage patterns. We may use cookie data to "recognize" you when you return to the Website, to save your Account ID, to track usage information, to troubleshoot how the Website operates, and for internal analysis of how people use the Website. Should you decide not to accept cookies from the Website, you will limit the functionality we can provide you. You may manage or disable cookies on your browser at any time.

Play Hockey Group may also gather certain specific geolocation data drawn from your device's GPS, Bluetooth and WiFi signals and nearby cell towers. We receive this information, for example, when you choose to use location-enabled services that we offer now or in the future. Additionally, we may collect information about your location if you provide your address or postal code.

You may control the use of such tools through your settings on your computer or mobile device. Your restriction on the use of such tools may affect your use of some or all of the features on our Platforms.

(vi) Commercial Information

When you register for Services for which payment is required, payment is processed through third party registration/data processing service contractors as part of the registration process and are subject to third party terms and conditions as indicated above. While Play Hockey Group will collect and maintain information in respect of your registration and registration history, including that payment has been successfully provided, Play Hockey Group does not retain your credit card information.

Play Hockey Group may also make available for sale certain products or services on our Platforms or through any other applications or Services we offer from time to time. In order to facilitate your purchase and to provide for shipping services of purchased product, registration for a Play Hockey Group account may be required, and we may collect your name, address, email address and telephone number, and refer you to a third party registration/data processing service contractor for payment. Play Hockey Group does not directly administer payment processing. Third party terms may apply and will be indicated at the time of sale. Play Hockey Group may retain a history of any product purchases in connection with your Account.

Play Hockey Group is a Business User of the payment solutions offered by Stripe.com. As an End Customer of Stripe the data you provide to Stripe to facilitate any payments you are making to Play Hockey Group are governed by Stripe's Privacy Policy which can be found at https://stripe.com/en-ca/privacy.

  1. Information from Third-Party Sources

Play Hockey Group may receive Personal Information from third party sources as reasonably necessary to carry on our Services, subject to your prior consent or in accordance with applicable laws. In addition to the information we receive from you directly, we may obtain your name, email address, physical address, phone number, or other similar contact information about you from other companies and organizations, marketing and sales generation partners, advertising and analytics partners, and from service providers that may perform certain operations on our behalf. We may combine information received from other sources with information we have collected or may collect about you. We may also collect information that is publicly available, such as information about you when you interact with us through social media. We are not responsible for the accuracy of any information provided by other sources or the data practices of other sources.

Play Hockey Group may also acquire Personal Information in connection with our acquisition of other businesses or business assets, which shall be handled and administered in accordance with applicable laws.

What Personal Information Does Play Hockey Group Collect?

While requirements for the provision of Personal Information required may vary, Play Hockey Group typically collects the following:

  1. Registrant Information – (i) Contact/Identification Information, including full legal name, date of birth, passport information, address, email address, mailing address, telephone number and signature; (ii) Demographic Information, including language preferences, gender, relationship to team(s)/Player(s) (e.g., parent/legal guardian, coach, team manager), residency and citizenship; and (iii) Commercial Information, including Service history, experience/past participation in Events, payment information (to be processed by third party registration/data processing service contractors), waiver information, purchases and engagement with our App, our Website or any other applications we offer.
  2. Team Information – (i) Team/Roster Information, including Player Information (see (c) below), staff, manager and coaching information (e.g., full legal names, contact details, position), team names, league/division and event schedules; and (ii) for each Player identified to be a Minor on the team roster, Parent/Legal Guardian Contact Information, including full legal names, address, email address, mailing address, telephone number and signatures.
  3. Player Information – (i) Contact/Identification Information, including full legal name, date of birth, team jersey number, passport information, address, email address, mailing address, telephone number and signature; (ii) Demographic Information, including language preferences, gender, height, weight residency and citizenship; (iii) Statistical/Experience Information, including event schedules, position, performance metrics, play level, experience/past participation in Events and game play information (e.g., goals, penalty minutes, etc.); and (iv) Health/Medical Information, including emergency contact information and medical history (e.g., pre-existing conditions, allergies, medications).
  4. User Information – (i) Contact/Identification Information, including full legal name, date of birth, passport information, address, email address, mailing address, telephone number, user type (e.g., parent/legal guardian, Player, coach) and signature; (ii) Demographic Information, including language preferences, gender, residency and citizenship; and (iii) for each user who is identified to be a Minor, Parent/Legal Guardian Contact Information, including full legal names, address, email address, mailing address, telephone number and signatures.
  5. Usage Information – from all Users, Play Hockey Group may collect information including your browser type, operating system, internet or mobile network provider, website or app access time, duration of visit, referring website address, browsing and search history on our Platforms or any other applications we offer, interactions with our Platforms or any other applications we offer, advertisements, social media pages, IP address, device identifier information (which may include without limitation the type/brand of device you are using, device identifiers unique to your device, your internet service provider, and depending on your permissions, content that you have stored on your phone) and search engines used.
  6. Audio, electric, visual or similar information that you have shared with or submitted to Play Hockey Group, such as photographs, images, and video and audio recordings;
  7. Geolocation data may be collected if you subscribe for any location-enabled services in respect of your computer or mobile device.
  8. Information you provide to us through communications with you, such as information you provide by telephone, as part of email exchanges, or social media posts.

Purposes for Collection

Generally, we process and use personal information to provide and improve our products and services, including the Website, for purposes in our legitimate interests and for compliance with applicable laws.

 

To Improve our Business. We may use your IP address and similar Website use information to: (i) help diagnose problems with the Website, administer and improve the Website, measure use of the Website, and detect security issues with the Website; (ii) identify the type of web browsers used, the pages viewed, the websites from which a visitor found the Website, and the search terms and search engines used to find the Website; and (iii) gather other analytics information relating to use and navigation of the Website. This information does not identify you personally. On occasion we may aggregate this data with data from other users to track overall visitor traffic and usage patterns and provide this aggregate information to vendors, business partners, or corporate affiliates.

 

The information we obtain using standard Internet technology, such as web beacons, tracking pixels, and other similar technologies, enables us to customize the services we offer visitors to the Website, to deliver targeted content, and to measure the overall effectiveness of our online content, advertising, or programming, or other activities.

 

We may use your location information to provide personalized content and advertising, to enhance your experience with the Website, to assist us with analytics, and to improve the effectiveness of our Website.

 

We may use the information in an anonymous or aggregated format that does not identify you personally, which uses might include, without limitation, to train our AI services to close communication gaps and provide accurate results, and to train our AI services to evaluate a user’s financial situation; to evaluate existing products, services, and systems; to assist in the development of new products or services; research; advertising; and to identify trends and changes.

 

For Law Enforcement, Regulators and Other Parties for Legal Reasons. We may also disclose personal information in any of the following circumstances: (a) in response to a subpoena, search warrant, court order, or other legal process or request, or as may otherwise be required by law, rule, or regulation; (b) to protect and defend our rights or property or those of our corporate affiliates, business partners, or others; or (c) as we, in our sole discretion, believe is appropriate under exigent circumstances in response to a perceived threat to the personal safety, property, or rights of any person or organization.

 

In addition, since our database is a business asset, in the event we are reorganized or become part of another organization, you consent to the sale, assignment, or transfer of your personal information to a successor that acquires substantially all of our business assets, or to a corporate affiliate, as applicable.

 

We do not sell personal information to third parties. Other than as set forth in this Privacy Policy, we do not transfer, share or disclose personal information to third parties. We do not disclose personal information of individuals we know to be under the age of sixteen (16) to other businesses or third parties for consideration except as noted above.

Additionally, we may collect personal information from you in order to:

  • provide you with our Services;
  • communicate with you regarding our Services, including without limitation Events for which you are a Player, Registrant, participant or spectator or for which you may be interested in;
  • communicate with you about updates to our Terms of Use and other policies, our Events, and to obtain your feedback;
  • administer our Platforms, our Events and other Services;
  • facilitate, manage, personalize, and improve your Event and Platform experiences;
  • respond to your comments, questions and requests, and send you notices;
  • send you marketing materials and advertisements, relevant discount information, and tailor our content, advertisements, and offers if you have subscribed to receive additional marketing communications from Play Hockey Group;
  • allow you to participate in Play Hockey Group promotions, sweepstakes, and contests if you have entered to do so;
  • engage in auditing, research, analysis, marketing and advertising;
  • maintain and improve our Services or add to our Services and our offerings;
  • determine your location where you are subscribing for location enabled Services; and
  • prevent and address fraud, threats or harm, and breaches in our policies.

While we have provided our general purposes for the collection, use and disclosure above, any purposes not considered obvious to you will be specified prior to or at the time of collection or when your consent is sought by Play Hockey Group.

Use

Play Hockey Group will use your Personal Information solely for the purposes for which it was collected, to carry out our Services and as permitted by our agreements and by applicable law.

If a new purpose for the use of your Personal Information is required that is not directly related to an existing purpose for which you have consented, and subject to applicable law, Play Hockey Group will contact you to obtain a new or additional consent for such use of your Personal Information.

Communications

As indicated in this Privacy Policy, Play Hockey Group will utilize your Personal Information to communicate with you concerning your use of our Services.

In connection with your use of our Platforms and/or participation in or attendance at any Event for which you are registered or for which you have registered a Player, Play Hockey Group will communicate with you using the following means: email, text message or by telephone.

If you are a Minor, we may also use your parent(s)/legal guardian(s) email address to communicate with them about your Account, such as for the purposes of obtaining their consent for your use of our Services and/or the disclosure of your Personal Information. Parent(s)/legal guardian(s) access to a Minor’s Personal Information maintained by Play Hockey Group shall cease upon the Minor reaching the age of majority in their jurisdiction of residence, and at such point, the Minor shall be the contact point for their Personal Information.

Marketing Communications

We rely on your consent to send you direct marketing email messages about our products, Services and promotions and to deliver targeted advertisements to you by any approved communication source, including emails and text messages.

Google Analytics

 

We may use a tool provided by Google called “Google Analytics,” to collect and process information about your use of the Website. Google Analytics collects information such as how often users visit the Website, what pages they visit when they do so, and what other sites they used prior to coming to this Website. We use the information we get from Google Analytics only to improve the Website. Google Analytics only collects the IP address assigned to you on the date you visit the Website, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information.   • We may use a tool provided by Google called “Google Ads” to target ads to specific customers when they’re browsing on Google Search, YouTube, and other platforms. We only share with Google information that we collect directly from you through our websites, mobile applications, and other situations where you have shared information directly with us. To keep your information data secure, Google Ads will put data through a process called “hashing.” Hashing is a process that generates a value from input text using a one-way algorithm. This one-way function means it is nearly impossible to determine the original input if only based on the hash code. By providing your information to us, you consent to our use of Google Ads. In particular, we use “Meta Pixel”, a tool that allows us to measure, optimize, and build audiences for our ad campaigns. Meta Pixel Analytics collects information such as IP addresses, the pages you have visited, and other on-Site actions. Restricting Information and Opting Out

If you do not provide certain information to us, we may, in some circumstances, be unable to provide you with our Services. Play Hockey Group will tell you about the implications of not providing certain information.

Privacy Rights and Requests

Depending on where you reside, you may have rights under applicable laws concerning Personal Information we have collected about you, which may include the right to access your Personal Information we have, to ask us to delete, correct, or restrict the use of your Personal Information, to withdraw your consent to our use of your Personal Information, to ask how we have used your Personal Information, and to ask whether we have shared your Personal Information. We will honour your rights to the extent required by us under applicable law or as we may agree to honour in our sole discretion.

All privacy requests relating to your Personal Information, including those related to access to, rectification of, restriction of, processing of, sharing of, or objection to the processing of your Personal Information, withdrawal of consent to handle your personal information, the right to be forgotten, or to opt-out of the sale of your Personal Information (in case our policy changes), can be submitted to us one of the following ways:

All communications must be in the English language. Please clearly state what information you are requesting and any other requests you are making. You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.

We will respond to reasonable requests within the time limits established by applicable law or within a reasonable time if no time limit is established by applicable law.

If you or your authorized agent sends us an email requesting that we take action regarding your Personal Information or the right to be forgotten, the requesting email MUST come from the email address we have on file for you in order to verify that the request is valid and also to protect your Personal Information. All other requests must be made in writing or otherwise be verifiable as originating from you or your authorized agent. In order to protect your Personal Information and because people may have the same name, we will only provide or delete Personal Information that we can verify is associated with your particular email address or where we can reasonably identify the identity of the requestor.

For your protection, we may ask you for additional information to verify your identity. In most cases, we will provide the information you request and correct or delete any inaccurate Personal Information you discover. We reserve the right, however, to limit or deny your request to the extent permitted by applicable law if: (a) complying with the request may present a threat to the personal safety, property, or rights of any other person or organization; (b) complying with the request may lead to a violation of applicable laws or regulations; (c) we are not required to comply with the request because of a legal rule or exception; or (d) you have failed to provide us with sufficient evidence to verify your identity. We will not delete Personal Information if that Personal Information is related to an ongoing transaction or license agreement, or where deletion is not required by applicable law. We may also keep Personal Information for a reasonable period of time following any request where necessary to comply with applicable laws or where necessary to protect a legal right or fulfill a legal obligation.

Storage, Security and Retention

Play Hockey Group has adopted physical, technical, and administrative safeguards to help protect against unauthorized access, collection, use, disclosure or destruction of Personal Information that we collect and receive or that is under our control. However, please note that given inherent risks associated with online services and data transmission and storage, no data transmission or storage can be guaranteed to be 100% secure. As a result, while we strive to protect your information and privacy, and take commercially reasonable steps to protect same in accordance with our legal obligations, we cannot and do not guarantee or warrant absolutely the security of any information you disclose or transmit to our Services and cannot be responsible for the theft, destruction, or inadvertent disclosure of your information, or any other disclosures outside of our control.

Your online access to some of your information may be protected with a password that you select. We strongly recommend that you select a unique password that is difficult to guess or determine and that you do not disclose your password to anyone. Please note that we will never ask you for your password in any unsolicited communication (such as letters, phone calls, or email messages).

We retain Personal Information for only as long as we need it to provide our Services, for purposes described in this Privacy Policy or our Terms of Use, or for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations - after which we take steps to delete or anonymize information. Among the criteria used to determine our retention periods include Service requests, rights you have granted to us in agreements or other documents, the length of your relationship with us, any retention or limitation periods under applicable laws.

Disclosure

PHUS and PHCI may transmit Personal Information from one party to the other as may be reasonably necessary to carry out the business and to provide our Services. We do not generally sell Personal Information as the term "sell" is traditionally understood. However, to the extent we sell your Personal Information as the term "sell" is defined under the California Consumer Protection Act (CCPA), you have the right to opt-out of the sale of your Personal Information by us to third parties at any time. Other than as set forth in this Privacy Policy and the consents you have given to us, we do not transfer, share or disclose Personal Information to third parties.

Play Hockey Group may disclose your Personal Information with your consent, for any purpose consistent with this Privacy Policy, or as permitted under applicable law. In connection with our business and in order to administer our Events and other Services, we may use the services of third party registration/data processing service contractors and transmit Personal Information in Canada, the United States or in other jurisdictions as are reasonably necessary to carry out processing in connection with our Services.

Play Hockey Group may also disclose Personal Information in any of the following circumstances: (a) in response to a subpoena, search warrant, court order, or other legal process or request, or as we may otherwise be required by law, rule, or regulation; (b) to protect and defend Play Hockey Group's rights or property or those of our affiliates or business partners, or others; or (c) as Play Hockey Group, in our sole discretion, believe is appropriate under exigent circumstances in response to a perceived threat to the personal safety, property, or rights of any person or organization.

In addition, since Play Hockey Group's databases are business assets, in the event PHCI and/or PHUS are reorganized or become part of another organization, you consent to the disclosure, sale, assignment, transfer and use of your Personal Information to a successor that acquires substantially all of our business assets, or to an affiliate, as applicable.

Online Privacy of Minors

Play Hockey Group recognizes the importance of protecting Minors online and complies with the Children’s Online Privacy Protection Act (COPPA). Play Hockey Group requires that for a Minor to be registered to play and participate in Events, such Minor’s parent(s)/legal guardian(s) must register them in one of the following ways:

  1. for individual registrations by a parent/legal guardian, parent(s)/legal guardian(s) must:
    1. register as a Registrant on our Website; and
    2. register the Player for the Event.
  2. for team registrations by an organizational head, team coach or team manager where Player information is provided to Play Hockey Group as part of a team roster, parent(s)/legal guardian(s) must:
    1. consent to the registration and disclosure of such information by the Registrant; and
    2. complete the registration process of the Player by executing the Play Hockey Group Assumption of Risk, Liability Waiver, Indemnity and Release.

 

Play Hockey Group requires that for a Minor to access and/or use our Platforms and related services, they must obtain the consent of their parent(s)/ legal guardian(s).

When Users are identified as being Minors, Play Hockey Group will obtain consent from such Minor’s parent(s)/legal guardian(s) for the creation of their Account and their access and/or use of our Services; subject always to such Minors having met the restriction requirements. If you are a parent/legal guardian and wish to revoke your previously provided consent, review information collected from your Minor or have that information deleted, please contact Play Hockey Group. If Play Hockey Group becomes aware that a Minor has provided us with Personal Information without their parent(s)/legal guardian(s) consent, or that the Minor does not meet the age restriction requirements, we will delete any Personal Information collected, unless we have a legal obligation to keep it, and terminate the Minor’s Account. Parent/legal guardian consent is mandatory for all Minors to access and/or use our Services. If Play Hockey Group makes material changes to how we collect, use, share or otherwise process Minor’s Personal Information, we will notify parent(s)/legal guardian(s) as required by applicable law.

We encourage parent(s)/legal guardian(s) to talk with all Minors under their care about the risks of disclosing Personal Information online.

When a Minor creates an Account and/or provides Personal Information to Play Hockey in connection with their use of our Platforms, Play Hockey Group will take additional steps to protect the privacy of such information, including:

  • obtaining consent from the parent(s)/legal guardian of the Minor before collecting or using the Minor’s Personal Information;
  • notifying parent(s)/legal guardian(s) about what Personal Information is being requested and how that Personal Information will be used and/or shared, such as through this Privacy Policy;
  • limiting the collection of Personal Information from Minors to no more than is reasonably necessary to accomplish the purpose of this collection; and
  • giving parent(s)/legal guardian(s) access to the Personal Information we have collected from their Minor and offering them the opportunity to request that such Personal Information be changed or deleted.

Play Hockey Group may ask the Minor for the email or mailing address or other contact information of their parent(s)/legal guardian(s) so that Play Hockey Group can notify such Minor’s parent(s)/legal guardian(s) of the disclosure of such Minor’s Personal Information and to obtain their consent and permission. In the event Play Hockey Group contacts a Minor’s parent(s)/legal guardian(s), Play Hockey Group will inform such parent(s)/legal guardian(s) what we will do with the Minor’s Personal Information, how they can review their Minor’s Personal Information, and how they can ask Play Hockey Group to delete such Personal Information. Play Hockey Group will not keep a Minor’s Personal Information unless their parent(s)/legal guardian(s) provide Play Hockey Group with their consent to do so.

Play Hockey Group: (1) does not knowingly collect Personal Information from Minors without the consent of a parent/legal guardian, except in limited circumstances authorized by applicable law; (2) collects Usage Information automatically and uses technology such as cookies to provide functionality and support Play Hockey Group’s operations; (3) does not ask for more Personal Information than is necessary for a Minor’s use of our Services; and (4) allows parent(s)/legal guardian(s) to request that Play Hockey Group update their Minor’s Personal Information.

 

Third Party Links

Our Services and those of third party registration/data processing service contractors may contain links to other sites that we do not own or operate. Links to our Services may also be featured on third party services on which we advertise. We provide links to third-party services as a convenience to Users. These links are not intended as an endorsement of or referral to the linked services. The linked services will be subject to third party terms and we recommend that you read third party privacy statements, notices, and terms of use or other such documents carefully. We do not have any control over such services and therefore we take no responsibility and assume no liability for the manner in which those entities operate or their privacy practices in terms of the collection, use, disclosure of Personal Information, their security practices, or how they otherwise treat your information.

To the extent that a privacy policy of any third party provider is inconsistent with this Privacy Policy, this Privacy Policy shall take precedence.

Review and Destruction

Play Hockey Group shall review and audit its Personal Information administration practices on an annual basis and shall ensure that it has set deletion policies for electronic records and destruction policies for physical records in accordance with applicable laws and Play Hockey Group's legal obligations.

All deletions and destruction of records containing Personal Information shall be completed in a manner that safeguards the confidentiality of all Personal Information.

Breach Notifications

In the event of a privacy breach, Play Hockey Group will notify affected parties and oversight bodies as and when required to do so under applicable law.

Privacy Policy Subject to Change

Play Hockey Group may make changes to this Privacy Policy from time to time, and will provide a notice of change on our App and/or Website. It is your obligation to review any changes made to this Privacy Policy and to monitor our Platforms for notice of any updates. Your continued use of our Platforms, participation in or attendance at Play Hockey Group Events, and/or use of any other Services shall be deemed to be your acceptance of this Privacy Policy and any changes made thereto.

Dispute Resolution

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to this Privacy Policy shall be resolved exclusively through final and binding arbitration and not through litigation in court, except where prohibited by law. The arbitrator shall have the exclusive authority to award any remedy available under applicable law, subject to the limitations contained in this Privacy Policy, and to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of this agreement is void or voidable.

Prior to initiating arbitration, the party asserting a claim must provide written notice of the claim to Play Hockey Group describing the nature of the dispute and the relief sought. The parties agree to attempt to resolve the dispute in good faith for a period of sixty (60) days following such notice before initiating arbitration.

The locale of arbitration and applicable law shall depend on where the Services giving rise to the dispute were provided.

  • Services provided in Canada: Arbitration shall take place in Winnipeg, Manitoba, in accordance with The Arbitration Act (Manitoba) before a single neutral arbitrator, governed by the laws of the Province of Manitoba, Canada, without regard to conflict of laws principles, and conducted under and administrated by the Arbitration Rules of the ADR Institute of Canada and administered by it.
  • Services provided in the United States: Arbitration shall take place in Hennepin County, Minnesota, governed by Minnesota law and the Federal Arbitration Act without regard to conflict of laws principles, and conducted under and administrated by the Consumer Arbitration Rules of the American Arbitration Association (“AAA”). The payment of filing, administration, and arbitrator fees shall be governed by the AAA Consumer Arbitration Rules, and Play Hockey Group shall pay any such fees required under those rules beyond the filing fee that would apply to filing a civil action in court.

By accessing/using our Services and/or disclosing Personal Information to us, you understand and agree you are waiving the right to bring a lawsuit in court or to have a trial before a judge or jury for any claim covered by this arbitration agreement. To the fullest extent permitted by law, any arbitration shall be conducted only on an individual basis and not as a class, consolidated, or representative action.

To the extent not specified in any other agreement you may have with us, for Services provided in Canada or the United States, in the event of any dispute that cannot be resolved amicably, the parties irrevocably attorn to the exclusive jurisdiction of the Courts of Manitoba, Canada.

Additional Notice for California Residents

The following paragraphs are effective as of April 9, 2026 and apply to the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CPRA”) is applicable to Play Hockey Group’s business. This notice describes the personal information that we collect, the sources from which we collect it, the business purposes for which we use it, the limited circumstances under which we share personal information, and with whom we share it. These additional disclosures, which serve as a Notice at Collection under the CPRA are required by the CPRA.

Your Data Rights

If you are a California resident, you may exercise the following rights (subject to certain limitations at law) conferred by the CPRA in relation to the personal information that Play Hockey Group has collected about you. You have the right to:

  • request the deletion of your personal information collected by Play Hockey Group and to request Play Hockey Group tell its service providers and contractors to do the same;
  • opt-out of the sale of your personal information by Play Hockey Group;
  • request that Play Hockey Group disclose what categories and specific pieces of personal information about you that Play Hockey Group has collected, used, disclosed, and sold during the last 12 months;
  • not receive discriminatory treatment by Play Hockey Group for your exercise of privacy rights under the CPRA;
  • correct inaccurate personal information that Play Hockey Group has collected; and
  • limit the use and disclosure of sensitive personal information that Play Hockey Group has collected.

To make a CPRA request, you may contact Play Hockey Group as set forth in the above section (PRIVACY RIGHTS AND REQUESTS). Play Hockey Group will follow the above process to verify and process your request.

Personal Information

If you are a California resident, the term “personal information” as used in this Privacy Policy means information that identifies, relates to, describes, or is reasonably capable of being linked directly, or indirectly, with, an identified or identifiable person or household whether such data is in individual or aggregate form and regardless of the media in which it is contained, including, but not limited to, an individual’s name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. “Personal information” does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records.

CPRA Sensitive Personal Information Disclosure

The categories of data that Play Hockey Group collects and discloses for a business purpose include “sensitive personal information” as defined under the CPRA. Play Hockey Group does not use or disclose sensitive personal information for any purpose not expressly permitted by the CPRA.

Sale of Personal Information

Play Hockey Group does not generally sell personal information as the term "sell" is traditionally understood. However, to the extent Play Hockey Group sells your personal information as the term "sell" is defined under the CPRA, you have the right to opt-out of the sale of your personal information by Play Hockey Group to third parties at any time.

The personal information that Play Hockey Group collects or has collected from California consumers in the 12 months preceding the “Last Updated” date of this Privacy Policy, fall into the following categories established by the CPRA, depending on which of our Services is used:

  • Identifiers, including name, postal and email addresses, IP address, social media handles, username, password, name of parent/legal guardian, jersey number, passport expiration, passport name, passport surname, passport country, citizen country, phone number, date of birth, user type, location and other contact information used to register and access Play Hockey Group’s products and services, to register for Play Hockey Group’s programs, or to contact Play Hockey Group by phone or through our online services;
  • The following categories of personal information described in California Civil Code § 1798.80(e): (1) the personal information listed in the preceding bullet point as “identifiers,” (2) signatures, (3) payment information, and (4) the other information that identifies, relates to, describes, or is capable of being associated with, a particular individual;
  • Characteristics of protected classifications under California or federal law, such as race, color, religion or creed, national origin or ancestry, language preference, sex (including gender, pregnancy, sexual orientation, and gender identity), age, physical or mental disability, veteran status, genetic information, and citizenship;
  • Commercial information, including Services history, experience and previous Events, payment information, waiver information, purchases and engagement with our App, our Website or any other applications we offer;
  • Internet or other electronic network activity information, including your browser type, operating system, internet or mobile network provider, website or app access time, duration of visit, referring website address, browsing and search history on our App, our Website or any other applications we offer, interactions with our App, our Website or any other applications we offer, advertisements, social media pages, IP address, device identifier information (which may include without limitation the type/brand of device you are using, device identifiers unique to your device, your internet service provider, and depending on your permissions, content that you have stored on your phone), search engines used;
  • Geolocation data, including location enabled services such as WiFi and GPS;
  • Audio, electric, visual or similar information, such as photographs, images, and video and audio recordings;
  • Employment data, including employment history provided when applying for a job with Play Hockey Group;
  • Non-publicly available educational information;
  • Inferences, including predictions about your interests, preferences, and purchase preferences; and
  • Sensitive personal information which includes sub-categories: government identifiers, account access credentials, precise geolocation, racial or ethnic origin, religious beliefs, union membership, citizenship or immigration status, genetic data, mail, email, or text message contents, unique identifying biometric information, height; weight, health information including any relevant medical conditions, allergies, medications and gender information.

Play Hockey Group collects and uses these categories of personal information for the business and commercial purposes described above in the Sections 1 through 3 of this Privacy Policy, including to provide and manage our Platforms, to provide customers with Play Hockey Group products and services, and to better understand its customers and users. Play Hockey Group may also use the information collected for its own other operational purposes, purposes for which it provides you additional notice, for purposes disclosed elsewhere in this Privacy Policy, or for purposes compatible with the context in which the personal information was collected.

In the event that we enter into, or intend to enter into a transaction that alters the structure of our business, such as a reorganization, merger, sale, joint venture, assignment, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we may share Personal Information with third parties in connection with such transactions. Any other entity which buys us or part of our business will have the right to continue to use your Personal Information, but subject to the terms of this Policy.
