PRIVACY POLICY

At Play Hockey, we value your commitment to the game and we appreciate your involvement in the Play Hockey community.   This Privacy Policy describes the manner in which Play Hockey, USA Inc. and Play Hockey Canada Inc., and any affiliates we establish from time to time, (collectively "Play Hockey", "we", "us" and "our") collect, use, store, share, disclose and administer Personal Information.  If any term of this Privacy Policy applies only to Play Hockey USA, Inc. or to Play Hockey Canada Inc., it will be specifically identified in this Privacy Policy. 

"You" and "your" as used in this Privacy Policy refers to: (i) the registrant, namely the adult providing personal information (parent, legal guardian, team coach, and/or team manager) to Play Hockey and who shall be of the age of majority or older in his/her/their jurisdiction of residence AND in the jurisdiction where the Play Hockey event or activity for which he/she/they have registered a participant will be located, AND (ii) any corresponding participant registered by the registrant for a Play Hockey event or activity, namely the minor child for whom the registrant has lawful authority as parent/legal guardian to register for Play Hockey Services; (iii) any other user of our Services.  Our website, any Play Hockey app, and our Services (other than participation in events and activities for which a minor child has been registered by their parent/guardian) are not intended for use by those under the age of majority.

"Services" as used in this Privacy Policy means our website, any Play Hockey app, any Play Hockey events, activities or undertakings engaged in by Play Hockey from time to time.    

THIS PRIVACY POLICY APPLIES TO YOUR USE OF OUR WEBSITE (playhockey.com), ANY APP WE MAY MAKE AVAILABLE AND TO ALL PERSONAL INFORMATION THAT WE COLLECT WHETHER ONLINE OR OFFLINE, AND APPLIES TO ANY OF YOUR USES OF OUR SERVICES / EVENTS / ACTIVITIES / UNDERTAKINGS REGARDLESS OF HOW YOU REGISTER, ATTEND, USE, PARTICIPATE IN OR ACCESS THEM.  

BY USING OUR SERVICES AND/OR BY PROVIDING PERSONAL INFORMATION TO PLAY HOCKEY (WHETHER DIRECTLY OR THROUGH OUR DATA PROCESSING SERVICE PROVIDERS), YOU ARE AGREEING TO THE TERMS OF THIS PRIVACY POLICY AND TO OUR TERMS OF USE, AND TO THE COLLECTION, USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION BY PLAY HOCKEY AS DESCRIBED IN THIS PRIVACY POLICY.  THIS PRIVACY POLICY IS IN ADDITION TO ANY CONTRACT TERMS YOU ENTER INTO WITH PLAY HOCKEY.

NOTE THAT PERSONAL INFORMATION COLLECTED BY PLAY HOCKEY MAY BE SHARED, TRANSMITTED AND STORED OUTSIDE OF YOUR COUNTRY OF RESIDENCE AND MAY NOT BE PROTECTED TO THE SAME DEGREE AS UNDER THE DATA PROTECTION LAWS OF YOUR COUNTRY OF RESIDENCE.  BY PROVIDING PERSONAL INFORMATION TO PLAY HOCKEY AND REGISTERING/SUBSCRIBING FOR PLAY HOCKEY SERVICES / EVENTS / ACTIVITIES / UNDERTAKINGS, FOR YOURSELF AND OTHERS, YOU ARE CONSENTING TO THE COLLECTION, USE, STORING, SHARING, DISCLOSING AND ADMINISTRATION OF YOUR PERSONAL INFORMATION AS SET FORTH IN THIS PRIVACY POLICY. 

PLAY HOCKEY USA, INC. IS BASED IN MINNESOTA, U.S.A. AND PLAY HOCKEY CANADA INC. IS BASED IN MANITOBA, CANADA.  PERSONAL INFORMATION MAY BE TRANSMITTED BETWEEN THE PLAY HOCKEY ENTITIES AND OUTSIDE OF THE JURISDICTION IN WHICH THE SERVICES WERE PROVIDED.  PERSONAL INFORMATION IS STORED IN BOTH CANADA AND THE UNITED STATES AND TRANSMITTED BACK AND FORTH BETWEEN CANADA AND THE UNITED STATES, AND WHICH MAY BE ACCESSED BY RELEVANT THIRD PARTY SERVICE PROVIDERS IN OTHER COUNTRIES THROUGHOUT THE WORLD.  Please be aware that information collected through the Services may be transferred to, processed, stored, and used outside of your home country.  Data protection laws in those countries may provide less protection and/or be different from those of your country of residence.  

YOUR USE OF THE SERVICES OR PROVISION OF ANY INFORMATION THEREFORE CONSTITUTES YOUR CONSENT TO: (I) TRANSFERRING (TO AND FROM PLAY HOCKEY), (II) PROCESSING, (III) USAGE, (IV) SHARING, AND (V) STORAGE OF YOUR INFORMATION, INCLUDING PERSONAL INFORMATION, IN ANY OF THOSE JURISDICTIONS AS SET FORTH IN THIS PRIVACY POLICY.

Personal Information

Personal Information in this Privacy Policy refers to information about an identifiable individual.  This definition of Personal Information does not include anonymous, de-identified or aggregated information – which is any information that does not include an individual's name, contact information nor any other information that could reasonably be expected to identify or be linked to an individual.

Collection

At Play Hockey, we collect Personal Information as necessary to provide you with requested Services and our collection practices are designed to comply with the consents you provide to the collection, use and disclosure of your Personal Information.  You may, from time to time, choose to provide Play Hockey with Personal Information in addition to that which is required for the provision of Services for specific purposes as outlined at the time of collection (for example to participate in surveys, promotional contests etc.). 

We collect your Personal Information through various means, including when you provide it to us by contacting Play Hockey directly or by using or subscribing for our Services, from our third party registration/data processing service providers when you register for our Services, when you authorize a third party to provide your Personal Information to us (for example when an organizational head/team coach/team manager registers a team for a Play Hockey event), as well as automatically through your use of our website, any apps we offer, or when you connect with Play Hockey through our various social media platforms.  We have set out our collection practices in more detail below. 

We may also collect and assemble certain Personal Information over the course of the delivery of our Services for example event schedules, roster information, participant player statistics, play level and age groups, and other game play information (goals, penalty minutes etc.) , participant player positions and otherwise.  Personal Information that we collect and assemble over the course of the delivery of our event or activity services may be made publicly available on our website or on our social media platforms  in connection with our event and activity administration and operations.  Play Hockey also reserves the right to photograph and record Play Hockey events and activities and Play Hockey may publicly display, distribute or broadcast those photographs/recordings, now or at any point in the future pursuant to provided consents.  

Play Hockey may also acquire Personal Information in connection with businesses or business assets that we acquire, which we will administer in accordance with applicable laws.  

We have set out specific details below concerning the general categories of Personal Information that Play Hockey collects and specific requirements regarding our privacy practices:

  1. Play Hockey Event and Activities Registration Information

(i) Registration/Data Processing Service Providers

In order to provide our Services and to collect Personal Information to facilitate registrations for Play Hockey events, activities and other Services, Play Hockey uses the services of third party registration/data processing service contractors to facilitate your registration and to collect your Personal Information for Play Hockey.  When you select to register for a Play Hockey event or activity through our website (whether on an individual basis or in connection with a team registration), you will be automatically redirected to the applicable Play Hockey designated registration/data processing service contractor.  As you are using a third party service to complete your registration, please note that you will also be subject to third party terms and conditions in addition to those of Play Hockey. Your Personal Information otherwise remains under the control of Play Hockey.

(ii) Parent/Legal Guardian Registrant Requirement

Given the nature of our business and our Services, it may be necessary for us to collect Personal Information concerning users generally as well as registrants (typically organizational heads, team coaches, team managers, parents and legal guardians), participants (players) and teams (full team registrations) depending on the nature of the event, activity or other requested Services.

Participants may be registered for Play Hockey events or activities through either: (i) individual registrations by parent/legal guardian registrants, or (ii) team registrations made by organizational head/team coach/team manager registrants where participant information is provided to Play Hockey as part of a roster, following which parent/legal guardian registrants are contacted to complete the participant registration process.  Parent/legal guardian consent and registration is mandatory for all minor children to be registered as participants in Play Hockey events and activities.

If you are submitting third party Personal Information to Play Hockey in connection with your registration, whether as an organizational head, team coach, team manager, parent/legal guardian or otherwise, you are confirming to Play Hockey that: (i) you have the legal authority to submit such information to Play Hockey, (ii) you have advised all such persons that you will be providing his/her/their name and contact information to Play Hockey in connection with identified Services, and (iii) that you have obtained express consent from the third party to provide his/her/their Personal Information to Play Hockey for these purposes. 

By registering a participant, you as the parent/legal guardian are agreeing that the organizational head, team coach or team manager shall have access to all communications relevant to the participant as a team member for the duration of the team event and related activities.

Participants who are under the age of majority are NOT permitted to register directly for Play Hockey Services and must be registered by a parent/legal guardian as part of the registration process.  

Play Hockey does not knowingly collect Personal Information directly from minor participants during registration, and all communications are with his/her/their parent/legal guardian. 

(iii) Team Registrants

Registrants who are submitting team registrations to Play Hockey for a Play Hockey team event will register as a registrant with Play Hockey and as part of their registration, provide Play Hockey with a roster containing participant names, birth dates and parent/legal guardian email addresses.  By submitting a roster to Play Hockey, you represent and warrant to Play Hockey that: (i) you have the authority to/are lawfully submitting such information to Play Hockey, (ii) you have advised all such persons that you will be providing his/her/their name and contact information to Play Hockey in connection with identified Services, and (iii) that you have obtained express consent from the third party to provide his/her/their Personal Information to Play Hockey for these purposes.

Play Hockey will use the provided Personal Information provided to contact the parent/legal guardian concerning the Play Hockey event or activity.  

By giving express consent to the registrant to provide the participant’s Personal Information to Play Hockey for team registration purposes, you as the parent/legal guardian are agreeing that the team coach or team manager shall have access to all communications relevant to the participant as a team member for the duration of the team event and related activities.

  1. Information We Collect or Receive When You Attend Our Events Or Activities And/Or Subscribe For Our Services

Play Hockey also collects or receives Personal Information about you when you attend our events or activities and when you subscribe for and use our Services.

(i) Subscriptions for Play Hockey News 

Subject to the communication options that you have selected, Play Hockey provides a subscription e-newsletter sent via email concerning notable happenings in terms of hockey and Play Hockey events, activities, undertakings and other Services.   

(ii) Photographs, Recordings and Broadcasting Rights

As a condition of attendance and participation in Play Hockey events and activities, Play Hockey reserves the right to take photographs and audio/video recordings of all Play Hockey events and activities forming part of the Services and to broadcast same.  Registrants and participants are required to sign a waiver and may be photographed and recorded as part of Play Hockey's activities (either by Play Hockey or by designated service providers) in connection with Play Hockey events.  Play Hockey has the right to collect and use such Personal Information and the right to publish, distribute and broadcast same among additional rights reserved to Play Hockey as per the Photographs, Recordings and Broadcasting Consent and Release that forms part of the Terms, Conditions, Waiver and Release Document already executed by all Registrants.

(iii) Team and Player Information

In connection with event administration, and as part of its business and promotional undertakings, Play Hockey may assemble, distribute and publish on its website or otherwise event schedules, roster information, participant player game information and statistics, play level and age groups, and other game play information (goals, penalty minutes etc.), participant player positions and other pertinent information.

(iv) Website and Technology

Play Hockey may collect information from you automatically when you access our website, any app we provide or use our Services on a computer or mobile device ("Usage Information").  Usage Information may include your IP address, device identifier information (which may include without limitation the type/brand of device you are using, device identifiers unique to your device, your internet service provider, and depending on your permissions, content that you have stored on your phone), browser type, operating system, information about your use of our website, any app we provide and our Services, and data regarding network connected hardware (such as computers or mobile devices), search engines used and the length of time spent on the Services and your website use, order and activity. 

We collect some of this information using cookies, log files and other tracking technologies such as web beacons to collect and store information about your interactions with our website including without limitation information about your browsing behavior. We use these technologies generally to offer you a more personalized and relevant experience based on your interests and to improve our Services, website and any app we offer.  Currently, our servers do not respond to browser “do not track” signals.

The methods we use to collect Usage Information include:

Log Files. Log files contain information about your use of the Services, such as IP address, browser type, Internet service provider, referring/exit pages, operating system, date/time stamps, and related data.

Cookies. We use cookies and other tracking technologies (such as web beacons) to collect and store information about your interactions with our website, including information about your browsing behavior. Cookies are small files that a website transfers to your device through a web browser that enable the website’s or a third party’s systems to recognize your device and to capture and remember certain information. Web beacons (also known as tracking pixels) are tiny graphics embedded invisibly on a webpage or in an email that may be used to deliver or communicate with cookies, to count users who have visited certain pages, and to understand usage patterns. 

Play Hockey may also gather certain specific geolocation data drawn from your device's GPS, Bluetooth and WiFi signals and nearby cell towers. We receive this information, for example, when you choose to use location-enabled services that we offer now or in the future.

You may control the use of such tools through your settings on your computer or mobile device.  Your restriction on the use of such tools may affect your use of some or all of the features on our website and any app we may offer now or in the future.

(v) Commercial Information

When you register for Services with Play Hockey for which payment is required, payment is processed through third party registration/data processing service contractors as part of the registration process and are subject to third party terms and conditions as indicated above.  While Play Hockey will collect and maintain information in respect of your registration and registration history, including that payment has been successfully provided, Play Hockey does not retain your credit card information. 

Play Hockey may also make available for sale certain products or services on its website or through any app we offer from time to time.  In order to facilitate your purchase and to provide for shipping services of purchased product, registration for a Play Hockey account may be required, and we may collect your name, address, email address and telephone number, and refer you to a third party registration/data processing service contractor for payment.  Play Hockey does not directly administer payment processing.  Third party terms may apply and will be indicated at the time of sale.  Play Hockey may retain a history of any product purchases in connection with your Play Hockey account.

Play Hockey is a Business User of the payment solutions offered by Stripe.com.  As an End Customer of Stripe the data you provide to Stripe to facilitate any payments you are making to Play Hockey are governed by Stripe's Privacy Policy which can be found at https://stripe.com/en-ca/privacy.

  1. Information from Third-Party Sources

Play Hockey may receive Personal Information from third party sources as reasonably necessary to carry on our Services, subject to your prior consent or in accordance with applicable laws.  

Play Hockey may also acquire Personal Information in connection with our acquisition of other businesses or business assets, which shall be handled and administered in accordance with applicable laws.  

What Personal Information Does Play Hockey Collect?

While requirements for the provision of Personal Information required for particular Services may vary, Play Hockey typically requires the following:

(a) Teams – (i) registrant information to be completed by the organizational head, team coach or team manager registering the team for Play Hockey events or activities (see below), and (ii) team roster containing the following information: Participant information: jersey number, gender, phone  number, height, weight, passport expiration, passport name, country and citizen country, and (iii) for each participant identified on the team roster, the name and email address of his/her/their parent/legal guardian to be used to facilitate registration by same for the Play Hockey events or activities identified.

(b) Registrants – (i) Contact Information: full legal name, gender, address, username, mailing address, telephone number, date of birth, email address; secondary email address, passport expiration date, passport surname, passport given names, passport country, citizenship country; (ii) Demographic information such as language preference, gender, (iii) Commercial Information; such as Services history, payment information (to be processed by third party registration/data processing service contractors, (iv) Play Hockey waiver information; (v) participant Personal Information (see below) where registrant registers such participant for Play Hockey activities; (vi) signature.

(c) Participants – (i) Contact information: full legal name, address, username, mailing address, telephone number, name of parent/legal guardian, date of birth, gender, height, weight, email address, passport expiration date, passport surname, passport given names, passport country, citizenship country; (ii) Experience and previous Play Hockey events or activities: ; (iii) Health and Medical Information namely any relevant medical conditions, allergies, medications; (iv) Emergency Contact Information; (v) waiver information.

(d)  Usage Information – from all users of our website or any app we may offer, Play Hockey may collect information such as browser type, operating system, internet or mobile network provider, website access time, duration of visit, referring website address, browsing and search history on our websites, and information regarding your interactions with our website, advertisements, social media pages and that you otherwise submit to us.

(e) Geolocation data may be collected if you subscribe for any location-enabled services in respect of your computer or mobile device.

(f) Information you provide to us through communications with you, such as information you provide by telephone, as part of email exchanges, or social media posts.

Purposes for Collection

We may collect the above-listed information from you in order to: 

  • provide you with our Services;
  • communicate with you regarding the Services, including without limitation events for which you are registered;
  • communicate with you about Play Hockey (Play Hockey News, updates to our terms and policies) and Play Hockey events, activities and undertakings and to obtain your feedback;
  • administer our events, activities, undertakings and other Services;
  • facilitate, manage, personalize, and improve your event, activity and online experiences;
  • respond to your comments, questions and requests, and send you notices;
  • send you marketing materials and advertisements, relevant discount information, and tailor our content, advertisements, and offers if you have subscribed to receive additional marketing communications from Play Hockey;
  • allow you to participate in Play Hockey promotions, sweepstakes, and contests if you have entered to do so;
  • engage in auditing, research, and analysis;
  • maintain and improve our Services or add to our Services offerings;
  • determine your location where you are subscribing for location enabled Services; and
  • prevent and address fraud, threats or harm, and breaches in our policies.

While we have provided our general purposes for the collection, use and disclosure above, any purposes not considered obvious to you will be specified prior to or at the time of collection or when your consent is sought by Play Hockey.

Use

Play Hockey will use your Personal Information solely for the purposes for which it was collected, to carry out requested Services from time to time and as permitted by our agreements and by applicable law.  

If a new purpose for the use of your Personal Information is required that is not directly related to an existing purpose for which you have consented, and subject to applicable law, Play Hockey will contact you to obtain a new or additional consent for such use of your Personal Information.

Communications

As indicated in this Privacy Policy, Play Hockey will utilize your Personal Information to communicate with you concerning requested Services.

(i) In connection with any Play Hockey events or activities for which you are registered, we will communicate using the following means with registrants: email, text message or by telephone.

(ii) Play Hockey does not communicate directly to participants who are below the age of majority. Registrants shall at all times have access to participant Personal Information for whom they are the registrant. Third party access to participant information will not be provided except with the consent of the registrant and the participant and in accordance with applicable laws.  

Registrant access to participant Personal Information maintained by Play Hockey shall cease upon the participant reaching the age of majority in his/her/their jurisdiction of residence, and at such point, the participant shall be the contact point for his/her/their Personal Information.

All information relevant to the participant will be provided to his/her/their parent/legal guardian who is a registrant, and information concerning Play Hockey events/activities will also be available on our website or through any app we offer.

(iii) For team registrations   

For team registrations, the organizational head, coach or team manager that registered the team shall receive all relevant notices for participants on their roster. 

Play Hockey sends marketing email communications only to those persons who have selected that option.  

Play Hockey does not send marketing communications of any kind to participants under the age of majority.  

Marketing Communications

We rely on your consent to send you direct marketing email messages about our products, Services and promotions and to deliver targeted advertisements to you by any approved communication source.

Restricting Information and Opting Out

If you do not provide certain information to us, we may, in some circumstances, be unable to provide you with the Services that you request. We will tell you about the implications of not providing certain information.

Privacy Rights and Requests 

Depending on where you reside, you may have rights under applicable laws concerning Personal Information we have collected about you, which may include the right to access your Personal Information we have, to ask us to delete, correct, or restrict the use of your Personal Information, to withdraw your consent to our use of your Personal Information, to ask how we have used your Personal Information, and to ask whether we have shared your Personal Information. We will honour your rights to the extent required by us under applicable law or as we may agree to honour in our sole discretion.

All privacy requests relating to your Personal Information, including those related to access to, rectification of, restriction of, processing of, sharing of, or objection to the processing of your Personal Information, withdrawal of consent to handle your personal information, the right to be forgotten, or to opt-out of the sale of your Personal Information (in case our policy changes), can be submitted to us one of the following ways:

All communications must be in the English language.  Please clearly state what information you are requesting and any other requests you are making.  You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.  

We will respond to reasonable requests within the time limits established by applicable law or within a reasonable time if no time limit is established by applicable law. 

If you or your authorized agent sends us an email requesting that we take action regarding your Personal Information or the right to be forgotten, the requesting email MUST come from the email address we have on file for you in order to verify that the request is valid and also to protect your Personal Information.  All other requests must be made in writing or otherwise be verifiable as originating from you or your authorized agent.  In order to protect your Personal Information and because people may have the same name, we will only provide or delete Personal Information that we can verify is associated with your particular email address or where we can reasonably identify the identity of the requestor. 

For your protection, we may ask you for additional information to verify your identity.  In most cases, we will provide the information you request and correct or delete any inaccurate Personal Information you discover. We reserve the right, however, to limit or deny your request to the extent permitted by applicable law if: (a) complying with the request may present a threat to the personal safety, property, or rights of any other person or organization; (b) complying with the request may lead to a violation of applicable laws or regulations; (c) we are not required to comply with the request because of a legal rule or exception; or (d) you have failed to provide us with sufficient evidence to verify your identity.  We will not delete Personal Information if that Personal Information is related to an ongoing transaction.  Even after a request, we may also keep Personal Information where necessary to comply with applicable laws or where necessary to protect a legal right or fulfill a legal obligation.

Storage, Security and Retention

Play Hockey has adopted physical, technical, and administrative safeguards to help protect against unauthorized access, collection, use, disclosure or destruction of Personal Information that we collect and receive or that is under our control.  However, please note that given inherent risks associated with online services and data transmission and storage, no data transmission or storage can be guaranteed to be 100% secure. As a result, while we strive to protect your information and privacy, and take commercially reasonable steps to protect same in accordance with our legal obligations, we cannot and do not guarantee or warrant absolutely the security of any information you disclose or transmit to our Services and cannot be responsible for the theft, destruction, or inadvertent disclosure of your information, or any other disclosures outside of our control.

Your online access to some of your information may be protected with a password that you select. We strongly recommend that you select a unique password that is difficult to guess or determine and that you do not disclose your password to anyone. Please note that we will never ask you for your password in any unsolicited communication (such as letters, phone calls, or email messages).

We retain Personal Information for only as long as we need it to provide the Services, for purposes described in this Privacy Policy, or for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations - after which we take steps to delete or anonymize information. Among the criteria used to determine our retention periods include Service requests, rights you have granted to us in agreements or other documents, the length of your relationship with us, any retention or limitation periods under applicable laws.

Disclosure

Play Hockey USA, Inc. and Play Hockey Canada Inc. may transmit Personal Information from one party to the other as may be reasonably necessary to carry out the business and to provide the Services.   We do not generally sell personal information as the term "sell" is traditionally understood.  However, to the extent we sell your personal information as the term "sell" is defined under the California Consumer Protection Act (CCPA), you have the right to opt-out of the sale of your personal information by us to third parties at any time.   Other than as set forth in this Privacy Policy and the consents you have given to us, we do not transfer, share or disclose Personal Information to third parties.

Play Hockey may disclose your Personal Information with your consent, for any purpose consistent with this Privacy Policy, or as permitted under applicable law. In connection with our business and in order to administer our events, activities and other Services, we may use the services of third party registration/data processing service contractors and transmit Personal Information in Canada, the United States or in other jurisdictions as are reasonably necessary to carry out processing in connection with our Services.  

Play Hockey may also disclose Personal Information in any of the following circumstances: (a) in response to a subpoena, search warrant, court order, or other legal process or request, or as we may otherwise be required by law, rule, or regulation; (b) to protect and defend Play Hockey's rights or property or those of our affiliates or business partners, or others; or (c) as Play Hockey, in our sole discretion, believe is appropriate under exigent circumstances in response to a perceived threat to the personal safety, property, or rights of any person or organization.

In addition, since Play Hockey's databases are business assets, in the event Play Hockey USA, Inc. and/or Play Hockey Canada Inc. are reorganized or become part of another organization, you consent to the disclosure, sale, assignment, transfer and use of your Personal Information to a successor that acquires substantially all of our business assets, or to an affiliate, as applicable. 

Online Privacy of Minor Children

Play Hockey recognizes the importance of protecting minor children online and complies with the Children’s Online Privacy Protection Act (COPPA).  Play Hockey requires that for a minor child to be registered to play in a Play Hockey event or activity, his/her/their parent/legal guardian must register the minor child in one of the following ways:

  1. for individual registrations by parent/legal guardian registrants must:
    1. register as a registrant on the Play Hockey website; and
    2. register the named participant for the event or activity.
  2. for team registrations made by an organizational head/team coach/team manager, they must obtain the consent of a parent/legal guardian for all minor children to be registered as participants in Play Hockey events and activities.

However, in the limited instances where a minor child may provide Personal Information to Play Hockey, Play Hockey will take additional steps to protect the privacy of such information, including: 

  • obtaining consent from the parent or legal guardian of the child before collecting or using the minor child’s Personal Information;
  • notifying parents about what Personal Information is being requested and how that Personal Information will be used and/or shared, such as through this Privacy Policy;
  • limiting the collection of Personal Information from minor children to no more than is reasonably necessary to accomplish the purpose of this collection; and
  • giving parents access to the Personal Information we have collected from their minor children and offering them the opportunity to request that such Personal Information be changed or deleted.

In the limited circumstances where Play Hockey collects a minor child’s email address without first getting the consent from the minor child’s parent or legal guardian, Play Hockey will ask the minor child for the email or mailing address of his/her/their parent or legal guardian so Play Hockey can notify the parent or legal guardian of their minor child’s request and obtain the parent or legal guardian’s permission. Play Hockey will inform the parent or legal guardian what it will do with the Personal Information the parent, legal guardian, or minor child provides, and how the parent or legal guardian can review their minor child’s Personal Information and ask Play Hockey to delete the Personal Information. In this circumstance, Play Hockey will not keep a minor child’s email address unless a parent or legal guardian gives the approval to do so.

Play Hockey may knowingly collect an email address from a minor child without the consent of a parent or legal guardian, but only in the following special cases:

  • If a minor child sends a request to Play Hockey, Play Hockey will keep their email address for long enough to respond to the minor child. Play Hockey deletes this information after answering the minor child’s question.
  • If a minor child signs up for an email newsletter on our website or other activity that requires multiple online contacts with the minor child, Play Hockey will ask the minor child for a parent’s or legal guardian’s email address, so Play Hockey can notify the parent or legal guardian and give the parent or legal guardian an opportunity to opt out of future email contact.

Play Hockey: (1) does not knowingly collect Personal Information from minor children without the consent of a parent or legal guardian, except in limited circumstances authorized by applicable law; (2) collects Usage Information automatically and uses technology such as cookies to provide functionality and support Play Hockey’s operations; (3) does not ask for more Personal Information than is necessary for a minor child to participate in an activity; (4) takes steps to prevent minor children from disclosing Personal Information; and (5) allows parents to request that Play Hockey update their minor children’s Personal Information.

Third Party Links

Our Services and those of third party registration/data processing service contractors may contain links to other sites that we do not own or operate. Also, links to our Services may be featured on third party services on which we advertise. We provide links to third-party services as a convenience to our users. These links are not intended as an endorsement of or referral to the linked services. The linked services will be subject to third party terms and we recommend that you read third party privacy statements, notices, and terms of use or other such documents carefully. We do not have any control over such services and therefore we take no responsibility and assume no liability for the manner in which those entities operate or their privacy practices in terms of the collection, use, disclosure of Personal Information, their security practices, or how they otherwise treat your information.

To the extent that a privacy policy of any third party provider is inconsistent with Play Hockey's Privacy Policy, the Play Hockey Privacy Policy shall take precedence.

Review and Destruction

Play Hockey shall review and audit its Personal Information administration practices on an annual basis and shall ensure that it has set deletion policies for electronic records and destruction policies for physical records in accordance with applicable laws and Play Hockey's legal obligations. 

All deletions and destruction of records containing Personal Information shall be completed in a manner that safeguards the confidentiality of all Personal Information.

Breach Notifications

In the event of a privacy breach, Play Hockey will notify affected parties and oversight bodies as and when required to do so under applicable law.

Privacy Policy Subject to Change

Play Hockey may make changes to this Privacy Policy from time to time, and will provide a notice of change on its website.  It is your obligation to review any changes made to this Privacy Policy and to monitor our website for notice of any updates.  Your continued use of our website or Play Hockey Services shall be deemed to be your acceptance of this Privacy Policy and any changes made thereto.

Governing Law

Services offered by Play Hockey in Canada are provided by Play Hockey Canada Inc., and the governing law for those Services and this Privacy Policy as it applies thereto are the laws of the Province of Manitoba and Canada.

Services offered by Play Hockey in the United States are provided by Play Hockey USA, Inc., and the governing law for those Services and this Privacy Policy as it applies thereto are the laws of the State of Minnesota.

To the extent not specified in any other agreement you may have with us, for Services provided in Canada or the United States, in the event of any dispute that cannot be resolved amicably, the parties irrevocably attorn to the exclusive jurisdiction of the Courts of Manitoba, Canada.

Additional Notice for California Residents

The following paragraphs are effective as of January 9, 2024 apply to the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CPRA”) is applicable to Play Hockey’s business. This notice describes the personal information that we collect, the sources from which we collect it, the business purposes for which we use it, the limited circumstances under which we share personal information, and with whom we share it.  These additional disclosures, which serve as a Notice at Collection under the CPRA are required by the CPRA.

Your Data Rights

If you are a California resident, you may exercise the following rights (subject to certain limitations at law) conferred by the CPRA in relation to the personal information that Play Hockey has collected about you. You have the right to:

  • request the deletion of your personal information collected by Play Hockey and to request Play Hockey tell its service providers and contractors to do the same; 
  • opt-out of the sale of your personal information by Play Hockey; 
  • request that Play Hockey disclose what categories and specific pieces of personal information about you that Play Hockey has collected, used, disclosed, and sold during the last 12 months; 
  • not receive discriminatory treatment by Play Hockey for your exercise of privacy rights under the CPRA;
  • correct inaccurate personal information that Play Hockey has collected; and
  • limit the use and disclosure of sensitive personal information that Play Hockey has collected. 

To make a CPRA request, you may contact Play Hockey as set forth in the above section (PRIVACY RIGHTS AND REQUESTS).  Play Hockey will follow the above process to verify and process your request.

Personal Information

If you are a California resident, the term “personal information” as used in this Privacy Policy means information that identifies, relates to, describes, or is reasonably capable of being linked directly, or indirectly, with, an identified or identifiable person or household whether such data is in individual or aggregate form and regardless of the media in which it is contained, including, but not limited to, an individual’s name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Personal information” does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records. 

CPRA Sensitive Personal Information Disclosure

The categories of data that Play Hockey collects and discloses for a business purpose include “sensitive personal information” as defined under the CPRA.  Play Hockey does not use or disclose sensitive personal information for any purpose not expressly permitted by the CPRA.

Sale of Personal Information

Play Hockey does not generally sell personal information as the term "sell" is traditionally understood.  However, to the extent Play Hockey sells your personal information as the term "sell" is defined under the CPRA, you have the right to opt-out of the sale of your personal information by Play Hockey to third parties at any time.

The personal information that Play Hockey collects or has collected from California consumers in the 12 months preceding the “Last Updated” date of this Privacy Policy, fall into the following categories established by the CPRA, depending on which of the Services is used:

  • Identifiers, including name, postal and email addresses, IP address, social media handles, username, password, name of parent/legal guardian, jersey number, passport expiration, passport name, passport surname, passport country, citizen country, phone number, date of birth, and other contact information used to register and access Play Hockey’s products and services, to register for Play Hockey’s programs, or to contact Play Hockey by phone or through our online services; 
  • The following categories of personal information described in California Civil Code § 1798.80(e): (1) the personal information listed in the preceding bullet point as “identifiers,” (2) signatures, (3) payment information, and (4) the other information that identifies, relates to, describes, or is capable of being associated with, a particular individual;   
  • Characteristics of protected classifications under California or federal law, such as race, color, religion or creed, national origin or ancestry, language preference, sex (including gender, pregnancy, sexual orientation, and gender identity), age, physical or mental disability, veteran status, genetic information, and citizenship;
  • Commercial information, including Services history, experience and previous Play Hockey events or activities, payment information, waiver information, purchases and engagement with the Play Hockey website;
  • Internet or other electronic network activity information, including your browser type, operating system, internet or mobile network provider, website access time, duration of visit, referring website address, browsing and search history on Play Hockey websites, interactions with the Play Hockey website, advertisements, social media pages, IP address, device identifier information (which may include without limitation the type/brand of device you are using, device identifiers unique to your device, your internet service provider, and depending on your permissions, content that you have stored on your phone), search engines used;
  • Geolocation data, including location enabled services such as WiFi and GPS;
  • Audio, electric, visual or similar information, such as photographs, images, and video and audio recordings;
  • Employment data, including employment history provided when applying for a job with Play Hockey;
  • Non-publicly available educational information;
  • Inferences, including predictions about your interests, preferences, and purchase preferences; and
  • Sensitive personal information which includes sub-categories: government identifiers, account access credentials, precise geolocation, racial or ethnic origin, religious beliefs, union membership, citizenship or immigration status, genetic data, mail, email, or text message contents, unique identifying biometric information, height; weight, health information including any relevant medical conditions, allergies, medications, gender, and sex life or sexual orientation information.

Play Hockey collects and uses these categories of personal information for the business and commercial purposes described above in the Sections 1 through 3 of this Privacy Policy, including to provide and manage this Site, to provide customers with Play Hockey products and services, and to better understand its customers.  Play Hockey may also use the information collected for its own other operational purposes, purposes for which it provides you additional notice, for purposes disclosed elsewhere in this Privacy Policy, or for purposes compatible with the context in which the personal information was collected.

Corporate Transactions

In the event that we enter into, or intend to enter into a transaction that alters the structure of our business, such as a reorganization, merger, sale, joint venture, assignment, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we may share Personal Data with third parties in connection with such transactions.  Any other entity which buys us or part of our business will have the right to continue to use your Personal Data, but subject to the terms of this Policy.
